What the review turns on

Regulatory themes in this market

DPDP
The Digital Personal Data Protection Act, 2023. The hospital is the Data Fiduciary; Pensieve is the Data Processor and says so in writing rather than blurring the roles.
CERT-In
The Directions of 28 April 2022: a six-hour incident reporting clock, 180-day log retention inside India, and synchronised time. Pensieve's own obligations run independently of the hospital's.
ABDM
Deliberately out of scope. The hospital holds its own HFR facility ID and its clinicians their own HPR IDs; Pensieve integrates on the hospital's credentials and is not the certified participant.
NHCX
Same boundary. The hospital holds the participant credentials and Pensieve calls the exchange as the hospital, on the hospital's own authority.
GST
Place-of-supply logic, the tax invoice format, e-invoicing and IRN where the turnover threshold is crossed.
MSMED
Pensieve is a registered micro enterprise, which brings the 45-day statutory payment obligation with it. It is disclosed before contracting, not raised after an invoice ages.
Stamp duty
Instruments executed in India attract duty, and unstamped instruments are inadmissible. Stamping is modelled as its own step because it blocks execution more often than any drafting point.

Bound values

What Pensieve’s paper resolves to in India

These are not descriptions of the contract. They are the values the contract binds to when it is rendered for this market, taken from the same token registry the documents themselves read from, so a clause and this table cannot disagree.

The global set, which applies in India too

Most of the register carries no jurisdiction because it carries all of them: how the platform is built, how it is defended, how data leaves at the end. Every market page sits on top of these. The eight below are the ones a hospital’s reviewers open first.
