1.1 By accessing or using the website you accept these Terms. If you do not accept them, do not use the website.

1.2 Edsol Edtech Pvt. Ltd. operates the website. In these Terms, "Pensieve", "we" and "us" mean Edsol Edtech Pvt. Ltd., a Private Limited Company bearing Corporate Identity Number [TO BE SUPPLIED] with its registered office at 28, Jamunather Bulandshahar Uttar Pradesh India. "You" means the person accessing the website.

1.3 These Terms may be changed at any time under 10. The version in force is the one published on the website when you access it, identified by its version number and Last Modified On date.

2.1 You may access the website, read it, and download or print material from it, for your own information and for the internal purposes of the organisation you represent, including evaluating whether to acquire the Platform.

2.2 You may quote from the website with attribution to Pensieve Labs and a link to the page quoted.

2.3 You may not:

2.3.1 copy, republish, redistribute or make available material from the website as a substantive part of another publication, product or service, whether or not for charge;

2.3.2 use an automated system to access the website at a rate or volume that degrades it for others, or that circumvents a rate limit;

2.3.3 attempt to gain unauthorised access to the website, any server or any account, or probe, scan or test its security other than under the Vulnerability Disclosure Policy (POL-GL-059);

2.3.4 introduce malicious code, or interfere with the website's operation, availability or integrity;

2.3.5 use the website to harvest personal data, including scraping contact details of Pensieve personnel;

2.3.6 frame, mirror or present the website so as to suggest an association, endorsement or relationship that does not exist;

2.3.7 use material from the website to train a machine-learning model without our prior written consent; or

2.3.8 use the website for an unlawful purpose, or in breach of the Acceptable Use Policy (ADD-GL-004) where you are also a user of the Platform.

2.4 We may withdraw or restrict access to the website, or to any part of it, at any time, without notice and without liability.

3.1 The website, its content, its design, its structure and the material published on it are owned by Pensieve or its licensors and are protected by copyright and other rights. Except as 2 permits, no right is granted.

3.2 Pensieve Labs, Pensieve and the associated marks and logos are ours. Permitted use is governed by the Trademark & Brand Usage Policy (POL-GL-062). No other use is permitted.

3.3 A third party's name or mark appearing on the website is that party's property and is used for identification only. Its appearance does not imply an endorsement in either direction, unless the website says so.

4.1 Information, not advice. The website is published for information. It is not legal, regulatory, tax, clinical, financial or professional advice, and must not be relied on as any of those. Where the website describes a law, a regulation, a standard or a deadline, it describes our reading of it at the date stated; it does not tell you what your organisation must do. Take your own advice.

4.2 No clinical content. Nothing on the website diagnoses, treats or gives guidance on the care of any individual. The Platform itself is not a medical device. See POL-GL-050 clause 4.2, ADD-GL-005 and DIS-GL-028.

4.3 No offer. Material describing the Platform, its capability, its deployment models or its commercial model is an invitation to discuss, not an offer capable of acceptance. A binding commitment arises only on an executed Order Form and the agreements it incorporates. A price, a timeline or a capability described on the website does not become a contractual term.

4.4 Forward-looking statements. Where the website describes a capability, a certification or a programme as planned, intended or under development, that is a statement of current intent and not a commitment. Pensieve holds no formal certification today, and the website says so directly; it does not imply one by describing a roadmap. See WPR-GL-005.

4.5 Accuracy. We take care that the website is accurate and current, and we date what we publish. We do not warrant that it is free from error or omission, or that it is up to date at the moment you read it. The authoritative version of any document referenced on the website is the version published in the Trust Center at https://trust.pensievelabs.org, with its own version number and Last Modified On date. Where the website and the Trust Center differ, the Trust Center governs.

4.6 Availability. We do not warrant that the website will be available, uninterrupted or error-free. No service level applies to the website.

5.1 Outbound links. Where the website links to a third-party site, the link is for convenience. We do not control that site, do not endorse it, and are not responsible for its content, its security or its handling of your personal data.

5.2 Inbound links. You may link to the website's home page or to a specific page, provided the link is fair, does not damage our reputation, does not suggest an association or endorsement that does not exist, and does not frame the page inside another site. We may require a link to be removed.

6.1 Enquiries and forms. Where you submit an enquiry, a contact form, a demonstration request or an access request, the personal data in it is processed under the Privacy Policy (POL-GL-053).

6.2 Do not send confidential or personal data. Do not send patient data, clinical records, or any person's sensitive personal data through a website form, an enquiry or an email to a general address. A website form is not a secure channel for that material, and we do not want to receive it. Where a secure exchange is needed, ask and we will provide one.

6.3 Unsolicited ideas. Where you send us an idea, a suggestion, a feature request or other material that is not confidential information disclosed under a non-disclosure agreement, we may use it without restriction, obligation or payment. Material disclosed under an executed or accepted non-disclosure agreement is governed by that agreement instead.

6.4 Security reports. A report of a security vulnerability in the website is made under the Vulnerability Disclosure Policy (POL-GL-059) to info@pensievelabs.org, not through a general contact form.

7.1 Personal data collected through the website is processed as described in the Privacy Policy (POL-GL-053), which states what is collected, why, on what basis, for how long, who it is shared with, and how to exercise your rights.

7.2 Cookies and similar technologies are described in the Cookie Policy & Consent Notice (POL-GL-054). That policy also records which Pensieve properties use no third-party analytics or tracking at all.

7.3 The statutory Grievance Officer and the route for a data-protection complaint are in POL-GL-066 and POL-GL-053.

8.1 As is. To the fullest extent Applicable Law permits, the website and its content are provided as is and as available, and all warranties, conditions and representations, express or implied, are excluded.

8.2 Liability. To the fullest extent Applicable Law permits, we are not liable for any loss arising from your use of, or inability to use, the website, including loss of profit, revenue, goodwill, business opportunity or anticipated savings, or any indirect or consequential loss, or any loss arising from reliance on material published on the website contrary to 4.1.

8.3 What is never excluded. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that Applicable Law does not permit to be excluded.

8.4 Your responsibility. You are responsible for configuring your own devices and network to access the website, and for your own protection against malicious code. We do not warrant that the website is free from it.

You will indemnify us against any claim, loss or cost arising from your breach of 2.3, or from your use of the website in breach of Applicable Law.

10.1 We may change these Terms. The current version, its version number and its Last Modified On date are published on the website and in the Trust Center. Superseded versions remain retrievable in the Trust Center.

10.2 A change takes effect on publication. Continued use of the website after publication is acceptance of the changed version. These Terms govern website use only; a change to them does not alter POL-GL-050, POL-GL-052 or any executed agreement.

11.1 Governing law. These Terms are governed by the laws of India.

11.2 Jurisdiction. The courts at Legal jurisdiction have exclusive jurisdiction, save that we may apply for urgent interim relief in any court of competent jurisdiction. Where you access the website as a consumer in a jurisdiction whose law gives you a non-excludable right to bring proceedings locally, this clause does not remove that right.
